1. Agreement to these Terms
These Terms form an agreement between you and Viewpoint Application Ltd, trading as VP Apps & Games, operator of BITI. By creating an account or using BITI you agree to these Terms, the Privacy Policy and applicable Community Guidelines. If you do not agree, do not use the service.
Nothing in these Terms removes rights that cannot lawfully be excluded under UK consumer law.
2. Eligibility and age
BITI is for people aged 16 or over. You must provide an accurate date of birth and must not create an account if you are under 16.
We may apply additional age-appropriate privacy, advertising, messaging, purchase, creator and monetisation restrictions to users aged 16-17. Paid Support Gifts and Creator Earnings are restricted to eligible adults aged 18+.
Purchases are also subject to app-store eligibility and any age/guardian rules that apply to the payment account.
3. Your account
You must give accurate information, keep your login details secure and tell us promptly if you think your account has been compromised.
Usernames must comply with our naming, impersonation and abuse rules. We may require a username change where necessary for safety, infringement or platform administration.
You may also choose to provide optional personalisation information, such as interests, a profile picture, mobile number and gender. Optional information can be skipped unless we clearly tell you that a particular feature needs it. Gender is used only for the purposes described in our Privacy Policy, is not displayed publicly by default, and is not used for advertising targeting at launch.
You are responsible for activity carried out through your account unless caused by BITI or another party for whom the law makes us responsible.
4. Profiles and visibility
Your profile may be Public or Private. Public profiles may be discoverable; Private profiles use follow/request controls.
Each BITI separately uses Private, Shared or Public visibility. You are responsible for choosing an appropriate setting before sharing personal or sensitive content.
Public BITIs may be discoverable, externally shared, saved, commented on, reacted to or remixed where those features are enabled. Shared BITIs are for authorised members. Private BITIs are for the owner.
5. Your content and ownership
You keep ownership of content and intellectual-property rights that you already own.
You grant BITI a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, process, adapt for technical display, transmit and show your content only as reasonably necessary to operate BITI, provide features you request, apply your visibility settings, moderate/safeguard the service and comply with law.
For Public BITIs/content, this licence also permits the public display, sharing and approved remix/attribution functions you choose to enable. The licence ends when the content/account is deleted, subject to reasonable backup, legal, safety and content already lawfully shared/remixed before deletion.
You must have the rights and permissions needed to upload or share content. External links/previews should preserve source attribution.
6. Acceptable use
Do not use BITI for illegal activity, harassment, threats, hate, sexual exploitation, child sexual abuse material, terrorism, fraud, scams, impersonation, doxxing, malware, unauthorised surveillance, intellectual-property infringement, spam or attempts to bypass safety/security controls.
Do not scrape the service, create fake engagement, manipulate creator eligibility, abuse Gifts/Cheers, operate self-gifting rings, evade bans or use automation/bots without written permission.
Additional Community Guidelines may explain these rules in more detail and form part of these Terms.
7. Messaging, groups and collaboration
Direct and Group messaging is provided for permitted users. Message requests, block/report controls and group administration may apply.
If you create or manage a group/Shared BITI, you must use member permissions responsibly. Adding someone to a Group Chat does not automatically give them access to a linked Shared BITI, and changing BITI membership does not silently change chat membership unless the product clearly asks you to confirm the change.
Messages are not currently described as end-to-end encrypted. Do not use BITI to send information that requires a higher level of confidentiality than the service provides.
8. Invitations and links
Invite links may grant or lead to access only after the recipient has authenticated and meets the relevant eligibility/permission requirements. Do not share a private invitation with people who should not receive it.
We may revoke or expire invitations where necessary for safety, security or access control.
9. BITI Official
BITI Official is a system-owned public account used for starter content, product education and one-way service messages. Users cannot Direct-message or add BITI Official to Group Chats/Shared BITIs.
Essential account/security notices are not dependent on following BITI Official. Editorial Official content may be followed/muted separately where available.
10. BITI AI
AI features process the prompts/content you choose to submit for an AI task and may use third-party AI providers.
AI outputs can be incomplete, inaccurate, outdated or unsuitable. You are responsible for reviewing outputs before relying on, sharing or acting on them.
Do not use BITI AI to generate unlawful, infringing, abusive or deceptive material or to make high-stakes professional decisions without appropriate qualified review.
AI Credits are a non-cash entitlement. Included credits reset according to the applicable plan. Purchased credits are not Creator Earnings and cannot be withdrawn as money. A failed AI job should not be charged where the system determines it did not complete successfully.
11. BITI Free and advertising
Free accounts may see clearly labelled BITI-inserted Sponsored/Ad content in approved surfaces such as Home and Discover.
BITI+ removes BITI-inserted platform ads. It does not necessarily remove creator/publisher paid partnerships, affiliate links or sponsored content that forms part of a post/BITI and is appropriately disclosed.
Ad/privacy controls and any consent required for tracking or personalised advertising are described in the Privacy Policy.
12. BITI+ subscriptions
The permanent list prices currently planned are: BITI+ Weekly £3.49, Monthly £9.99 and Annual £79.99. Actual store pricing, tax, currency and promotional offers may vary and will be shown before purchase.
Subscriptions may renew automatically through the app store/payment platform until cancelled. The store/payment flow will show renewal information and cancellation options. You should cancel through the same store/account used to subscribe unless another method is provided.
Promotional or birthday passes that are expressly described as non-renewing do not turn into paid subscriptions automatically.
Refunds and cancellation rights are subject to applicable consumer law and the relevant app-store/payment rules. Nothing here limits statutory rights.
13. BITI+ Together
One Plan Manager pays the full BITI+ Together subscription and can invite up to five additional accounts, for up to six accounts total. Invited members do not separately pay BITI for their seat.
The Plan Manager does not gain access to members' Private BITIs, Direct messages or private AI prompts merely because they pay.
Together members share the plan's included AI pool. Usage quantities may be visible to the Plan Manager, but private prompt/content should not be shown.
If the plan ends, members retain their accounts and content but lose the Together entitlement when the paid period ends. Removing a member does not delete that member's personal content.
14. Cheers, Gifts and Creator Earnings
Where enabled, Cheers are virtual credits used to send eligible paid Support Gifts. Cheers cannot be cashed out by ordinary users and are separate from AI Credits.
Free Celebration Gifts, Welcome Gift Passes and Test Cheers have no cash value and do not create Creator Earnings.
Eligible monetised creators may earn from paid Support Gifts. The currently approved commercial rule is 70% of eligible Net Gift Revenue to the creator and 30% to BITI, after applicable store fees, taxes, refunds, chargebacks and other adjustments.
Creator Earnings are available only to eligible adults aged 18+ who complete identity/KYC, payout and tax requirements and remain in good standing. The intended minimum payout is £25 on a monthly cycle where the feature is enabled.
Fraud, self-gifting, fake engagement, chargebacks and policy breaches may cause pending/available earnings to be withheld, reversed or adjusted, subject to applicable law and appeal rights.
15. Creator accounts and monetisation
Creator status and Monetised Creator status are separate. A 16+ user may be eligible for Creator tools, while cash monetisation requires 18+ and additional checks.
Creator applications and monetisation eligibility may consider public content, originality/meaningful contribution, account standing, age, activity, audience and anti-fraud signals. Material enforcement/monetisation decisions should have review or appeal routes where appropriate.
Paid partnerships, affiliate relationships and gifted products/services must be disclosed using the tools/labels BITI provides and any disclosure required by law.
16. Affiliate links and third-party services
Public BITIs, creator content or BITI Official content may contain links to third parties. Some links may be affiliate links, meaning BITI or a creator may earn a commission without changing the price you pay.
Third-party websites, products, bookings and services are controlled by those third parties and their own terms/privacy policies. BITI is not responsible for third-party content except where the law says otherwise.
17. Moderation, reporting, removal and appeals
We may use automated systems and human review to detect, limit or remove illegal, harmful, infringing, fraudulent or rule-breaking content/accounts.
We provide reporting and complaints processes. We may preserve evidence, restrict features, suspend accounts, remove content or terminate access where proportionate and permitted by law.
Where required or appropriate, we will explain enforcement decisions and provide an appeal/review route. We will apply published safety/Terms provisions consistently.
18. Account suspension and termination
You may stop using BITI and request account deletion. Some information may be retained for legal, security, financial or dispute reasons as explained in the Privacy Policy.
We may suspend or terminate accounts for serious/repeated breaches, legal/safety requirements, fraud/security risks or misuse of the platform. Where appropriate, we may first restrict a feature rather than the entire account.
19. Service changes and availability
BITI may add, change or retire features. We aim to give reasonable notice of material changes that affect paid entitlements or important user rights where practicable and legally required.
We do not guarantee uninterrupted availability, but we will use reasonable care and skill in providing the service as required by applicable consumer law.
20. Liability and consumer rights
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including rights you have under consumer law and liability that cannot lawfully be excluded.
Subject to those rights, BITI is not responsible for losses caused by matters outside our reasonable control, user-provided information, third-party websites/services, or decisions made solely in reliance on unverified user/AI content.
If you use BITI for business/commercial purposes, additional business terms may apply in the future.
21. Privacy
The BITI Privacy Policy explains what personal information we collect, including required account information and optional personalisation information such as interests or gender; why we use it; who we share it with; retention; advertising/AI; and your rights. It forms an important part of how the service operates.
22. Changes to these Terms
We may update these Terms to reflect product, legal, safety or business changes. We will notify users of material changes in an appropriate way. If the law requires consent to a change, we will ask for it.
23. Governing law and disputes
These Terms are governed by the laws of England and Wales, subject to mandatory consumer protections that may apply where you live. If you are a consumer in another part of the UK, you may also have rights to bring proceedings in your local courts.
Please contact Support first so we can try to resolve a complaint. Online-safety and privacy complaints may also be made to the relevant regulator where applicable.
24. Contact
Use the company, support and privacy contact details listed at the start of this document.
